📜 Luminariah — Terms of Service

These Terms of Service ("Terms") govern your use of Luminariah and all related services provided by Parallel Five LLC. By downloading, accessing, or playing the game, you agree to these Terms. When you create an account you are also asked to affirmatively accept these Terms and our Privacy Policy; we record which version you accepted and when. 1. App Store and Google Play Disclaimers

If you download Luminariah through Apple or Google, you acknowledge the following:

Acknowledgment: These Terms are between you and Parallel Five LLC, not Apple Inc. or Google LLC. Parallel Five LLC is solely responsible for the game and its content.

Maintenance & Support: Apple and Google have no obligation to furnish any maintenance or support services for the game.

Third-Party Beneficiary: Apple and Google are third-party beneficiaries of these Terms and have the right to enforce them against you.

2. Account Rules and Eligibility

Eligibility: Luminariah is for players aged 13 and older. In some regions a higher minimum age applies where local law requires it, and you must meet the minimum age for your region to create an account. You must provide accurate registration information, including a truthful date of birth used to enforce this requirement.

Account Security: You are responsible for all activity under your account. Account sharing is strongly discouraged and done at your own risk. Parallel Five LLC will not restore items lost due to account sharing.

3. Virtual Goods, Currency, and The Occultation System

Luminariah features in-game currencies, Occult Dust, Grimoires/Lexicons, Seals, and other digital items ("Virtual Goods"). Some Virtual Goods and in-game systems grant randomized rewards; the odds for each random mechanic are disclosed in-game and at luminariah.com/odds.

No Real-World Value: Virtual Goods are licensed to you, not sold. They have no real-world monetary value, cannot earn interest, and cannot be redeemed for fiat currency.

Final Sales: Except as required by applicable law or by the respective app store refund policies, all purchases are final and non-refundable.

EU/EEA Right of Withdrawal: If you are a consumer in the EU or EEA, you normally have a 14-day right to withdraw from a purchase of digital content. By purchasing Virtual Goods that are delivered to your account immediately, you expressly request immediate performance and acknowledge that you lose this right of withdrawal once delivery has begun. This does not affect your statutory rights in cases of faulty or misdescribed digital content. Details and how to contact us are provided at luminariah.com/withdrawal.

Game Balancing: Parallel Five LLC reserves the right to modify, nerf, buff, or remove Virtual Goods (including adjusting base roll percentages on Grimoires/Lexicons or Seal success rates) at any time to maintain game balance, without liability to you.

4. Code of Conduct and Fair Play

To maintain a healthy MMORPG environment, the following actions are strictly prohibited and will result in immediate account termination:

Cheating & Automation: Using bots, macros, auto-clickers, memory editors, or any third-party software to automate gameplay (such as automating Occult Dust gathering or combat).

Real Money Trading (RMT): Buying, selling, or trading Luminariah accounts, Virtual Goods, or in-game currency for real-world fiat money outside of the game.

Exploiting: Knowingly exploiting game bugs or server rate-limits to gain an unfair advantage.

Toxicity: Harassment, hate speech, or severe toxicity toward other players or Parallel Five LLC staff in any in-game chat or official community channels, including Discord and any other third-party platforms designed to be interactive within Luminariah.

5. User-Generated Content, Moderation, and Reporting

Any text, chat, or content you submit within the game remains yours, but you grant Parallel Five LLC a worldwide, royalty-free, perpetual license to display, moderate, or remove it. We monitor and moderate chat for toxicity, harassment, scamming, RMT, and other violations of these Terms. You can block other players and report objectionable content or behavior from within the game, and we review reports and take action, up to and including account termination. 6. Limitation of Liability & "As Is" Warranty

Luminariah is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Parallel Five LLC disclaims all warranties. We are not liable for server downtime, data loss, character rollbacks, or interrupted gameplay. In no event shall our liability exceed the amount you have paid to us in the preceding two (2) months. Nothing in these Terms limits any rights you have under mandatory consumer-protection laws in your jurisdiction.

7. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to Luminariah shall be governed by and construed in accordance with the laws of the State of Illinois, USA, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Illinois, USA, and you consent to the personal jurisdiction of such courts. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence.

8. Changes to These Terms

We may update these Terms to reflect game updates or legal changes. When we make material changes, we will update the "Last Updated" date above and, where appropriate, notify current users via an in-game notice or other reasonable means. Continued play after such notice constitutes your acceptance of the revised Terms.
